The City of Upland has no breed-specific dog ban. Its dangerous-dog rules in Chapter 6.08 regulate individual dogs by behavior, not breed. California Food and Agricultural Code Section 31683 prohibits cities from enacting breed-specific dog control programs, except for limited spay/neuter measures, so no breed is outlawed in Upland.
Upland does not restrict or ban any specific dog breed. Chapter 6.08 of the Municipal Code, Potentially Dangerous and/or Vicious Dogs, sets up a hearing-based process to declare an individual dog 'potentially dangerous' or 'vicious' based on its conduct, such as biting, unprovoked attacks, or injuring people or other animals. The chapter contains no breed-specific language and instead focuses on the behavior of the particular animal. This approach is consistent with California Food and Agricultural Code Section 31683, which provides that no program for regulating dangerous or vicious dogs adopted by a city or county may be specific as to breed. The state law does permit narrow breed-specific spay/neuter or breeding requirements, but it does not allow outright breed bans. A dog declared potentially dangerous or vicious in Upland may be subject to registration, special confinement conditions, conditional release, or, for vicious dogs, removal from the city or destruction under Sections 6.08.120 through 6.08.170. Owners of any breed should keep dogs licensed, vaccinated against rabies, and under control to avoid a dangerous-dog determination.
There is no breed ban to violate; however, a dog of any breed that bites or attacks may be declared potentially dangerous or vicious under Chapter 6.08, triggering registration, confinement orders, or removal.
