Summary
Fairfax County's Health Department can order owners to repair, secure, or remove deteriorated, structurally unsafe, or collapse-risk buildings as a public health or safety menace, then bill the owner and lien the property if the county has to do the work itself.
(a)When any condition that constitutes a public health or safety menace is found on occupied or vacant land or premises, the Director shall notify in writing the owner or occupant of the land or premises on which the condition exists and/or any other person who he believes is responsible for the health or safety menace. Such notice shall contain a description of the health or safety menace and the time within which the menace shall be abated, corrected or eliminated.
Full Breakdown
Under Chapter 46, a deteriorated, faulty-construction, collapse-prone, or unsecured vacant structure counts as a 'public health or safety menace.' The Director must give the owner written notice describing the problem and a deadline to fix it, mailed and published for two weeks. Absent an emergency, the county waits 30 days before acting itself.
Violations & Fines
If the county abates the condition itself, costs are charged to the owner and, if unpaid, become a lien on the property enforced the same way as delinquent local taxes.
