Summary
Sussex County's Code Official condemns any structure found unsafe or unfit for human occupancy under Chapter 71 of the county's Housing Standards, posting a placard reading "Condemned as Unfit for Human Occupancy or Use" and barring reoccupancy until repairs are approved. An unsafe structure is one so damaged, decayed, dilapidated or structurally unstable that partial or complete collapse is likely.
§ 71-26. Condemnation. A. General. When a structure is found by the Code Official to be unsafe or when a structure or part thereof is found unfit for human occupancy or use, it may be condemned pursuant to the provisions of this chapter and may be placarded and vacated. Such condemned structure shall not be reoccupied without approval of the Code Official, but such approval may not be withheld upon completion of specified corrections of violations. ... UNSAFE STRUCTURE: One in which all or part thereof is found to be dangerous to life, health, property or the safety of the public or the structure's occupants because it is so damaged, decayed, dilapidated, structurally unsafe or of such faulty construction or unstable foundation that it is likely to partially or completely collapse.

Full Breakdown
When the Code Official determines a building is unsafe, unfit for human occupancy or contains unsafe equipment, § 71-26 authorizes condemnation, placarding and forced vacation of the premises. The chapter defines an "unsafe structure" as one so damaged, decayed, dilapidated, structurally unsafe or built on an unstable foundation that partial or complete collapse is likely, and a "structure unfit for human occupancy" as one lacking maintenance, sanitary facilities, heat or ventilation, or infested with vermin. Before condemning, the Code Official must serve written notice under § 71-27 describing the violation, a correction deadline, the right to appeal, and the penalties for noncompliance; service is by personal delivery, certified mail, or posting on the structure plus a newspaper notice if the owner cannot be found.
Occupying or reoccupying a placarded structure without the Code Official's approval is itself a violation under § 71-28B. Where repair is unreasonable, § 71-32 lets the Code Official order the owner to raze the structure; if the owner misses the deadline, the county demolishes it and bills the cost as a lien on the property under § 71-33. An owner or occupant aggrieved by any of these actions has 10 days under § 71-31 to file a written appeal with the County Board of Appeals or a Community Board of Appeals, which stays enforcement until decided; a further appeal runs to Superior Court. Selling a property under an open compliance order without disclosing it to the buyer is separately unlawful under § 71-27F.
Violations & Fines
Violating any Chapter 71 provision or ignoring a Code Official's notice or order is a misdemeanor under § 71-30B, punishable by a fine of $25 to $500, up to 30 days in jail, or both, with each day of continued noncompliance charged as a separate offense. The nearest Justice of the Peace Court has exclusive jurisdiction. Unresolved cases go to the County Attorney, who may sue to force repair, removal or vacation of the structure.
