Mahwah requires owners and tenants of properties abutting public sidewalks to remove snow and ice from those sidewalks, keeping pedestrian routes safely passable after storms throughout the Township.
Under the Township's Streets, Sidewalks and Sanitation chapter, the owner or owners and tenant or tenants of lands bordering the flag or concrete sidewalks of public streets in Mahwah must remove all ice and snow from those sidewalks. The duty applies to residential and commercial frontages alike. While Mahwah does not always specify a fixed clearing window in the same way as some neighboring municipalities, owners are expected to clear promptly after a storm ends to prevent pedestrian hazards and exposure to slip-and-fall liability.
Failure to remove snow and ice from abutting sidewalks may result in summonses, fines, and Township-performed clearing with costs assessed against the property as a lien if owners fail to comply.
