Section 430-26, Snow and ice removal, adopted January 27, 2025 by Ordinance No. 02-24B as part of Article III, Sidewalk Maintenance, puts the clearing duty on the occupant of every lot or premises adjoining any street, shifting it to the owner only if the same are not occupied. the following day. The article does not set a separate civil-infraction fine specific to snow removal; instead it relies on the same notice-and-abatement mechanism used for the rest of Article III. Under § 430-27, an enforcing officer who finds a sidewalk out of compliance notifies the owner, occupant, or agent to abate the condition.

If the noncompliance is not corrected within 48 hours of that notice, § 430-28 lets the Village abate it directly, arranging for Village employees or a private contractor to clear the snow and ice, and charging the cost to the property and its owner at the standard hourly rate for labor and machinery used by the Village or the reasonable cost incurred by a private contractor, whichever is appropriate, plus an administrative fee under the master fee resolution. Because Article III carries no standalone penalty clause, a chronic violation could also fall back on the Village's general municipal civil infraction penalty in § 1-2, which allows a fine of $100 to $200 for a first offense, rising to $250 to $400 for a first repeat and at least $500 for a second repeat within 24 months, where the Code does not otherwise specify a fine.
