Under City Code Chapter 11 (Solid Waste Code), the City furnishes the black (trash) and blue (recycling) automated carts, and those containers remain city property. Section 11-9 requires all materials prepared for collection to be stored in a city-approved container until collected; unauthorized containers will not be serviced. Users must keep the container reasonably clean and free of intense odors, flies and other nuisances, and the lid must be kept down in a closed position at all times to prevent pests, except when filling, emptying or cleaning it. It is unlawful to deposit waste in a container you are not entitled to use, to intentionally damage a container, or to use it unsafely. Solid Waste Code violations are enforced under Sections 11-21 and 11-22: a $250 civil penalty per violation (Class 1 misdemeanor exposure of up to $2,500 / 6 months for criminal handling). The City may also remove a city-owned container from a noncompliant user's property.
