Elkhart County's Weed and Rank Vegetation Control subchapter (Chapter 92) makes it a violation to let plant life exceed eight inches on a residential parcel, meaning land used for residential purposes and no larger than three acres. Accumulated trash, debris and junk are covered too. The Plan Director issues notice, and if the owner does not comply the county cuts or removes the vegetation and charges removal plus administrative costs back to the parcel. Landscaped gardens and crops over eight inches are exempt unless they sharply deviate from the surrounding neighborhood.
Failure to comply lets the county abate, mowing or hauling, and bill the owner for removal and administrative costs. Civil penalties run up to $2,500, with each day of continued violation counted separately.
