Town Code section 9-51 requires owners and occupants of non-agricultural property to clear weeds, wild growth and undergrowth and to remove unsightly or unsanitary matter. The Town's landscape standard (section 12-33(s)) adds that yards and landscaped areas be kept neat, watered and trimmed. Enforcement is by certified-mail notice with a seven-day cure.
Overgrowth in Davie is handled primarily through Town Code section 9-51, 'Duty of owner or occupant to keep property free from waste, weeds, debris.' Subsection (b) requires owners or occupants of property zoned other than agricultural to clear and destroy all weeds, wild growth and undergrowth, while subsection (a) covers rubbish, debris and 'unsightly or unsanitary matter.' Davie's Code Compliance FAQ confirms that overgrowth is enforced under 9-51 and also points to Land Development Code section 12-33(s): 'All setback areas, yards, walkways, driveways and parking areas shall be maintained and kept in a neat and clean condition, free of refuse and debris,' and 'All landscaped areas shall be maintained in a live, healthy and growing condition, properly watered and trimmed,' with dead or badly damaged grass, shrubs or trees replaced with healthy material. Minimum landscape standards in Chapter 6 (section 6-37) are also cited by the Town in code-enforcement cases. The Town Code does not publish a specific grass-height number for the 9-51 weed standard; cases turn on whether weeds, wild growth or undergrowth are present. Because Davie keeps a rural and agricultural character, agriculturally zoned parcels are not subject to the weed-clearing requirement of 9-51(b).
Tall grass and overgrowth complaints go to Code Compliance (954-693-8237 / online form). The inspector issues a section 9-51 certified-mail notice giving seven days to cut and clear; if the owner fails, the Town may clear the property and lien the cost. Repeat or contested cases are heard by the Special Magistrate.
