Davie's Code Compliance Division enforces property condition under Town Code section 9-51, which makes the owner or occupant responsible for keeping property free of rubbish, debris, trash, weeds and unsightly or unsanitary matter. Failure to comply after a certified-mail notice can result in the Town clearing the property and recording a lien.
The Town of Davie enforces blight and neglected-property conditions chiefly through Town Code section 9-51, 'Duty of owner or occupant to keep property free from waste, weeds, debris.' Subsection (a) requires owners and occupants to clear and destroy all rubbish, debris, trash and unsightly or unsanitary matter, and subsection (b) requires clearing of weeds, wild growth and undergrowth on non-agricultural property. The Code Compliance Division (part of the Davie Police Department) describes its mission as keeping Davie 'safe, welcoming, and beautiful,' and its FAQ states that nuisance conditions 'can include graffiti, overgrowth, noise, odors and safety issues' and that owners must maintain property in a way that 'upholds the property values in their neighborhood.' Land Development Code section 12-33(s) adds that all setback areas, yards, walkways, driveways and parking areas must be kept neat and clean and free of refuse and debris, and that landscaped areas must be kept 'in a live, healthy and growing condition, properly watered and trimmed.' Graffiti is separately declared a public nuisance under section 6-44, and a chronic nuisance/eyesore can be cited under section 12-33(U). Cases are heard by the Town's Special Magistrate.
Complaints (overgrowth, trash, junk, graffiti) are filed via the Town's Online Complaint Form or 954-693-8237; allow 24-48 hours for an inspector. Under 9-51 the code inspector sends a certified-mail notice giving the owner seven (7) days to comply; if ignored, the Town may clear the property and record a lien in Broward County public records, collectible by foreclosure. Unresolved cases go to the Special Magistrate.
