Davie limits construction noise under Sec. 15-7(14). Without a special variance, construction must not exceed 50 dBA at a property boundary between 7:00 p.m. and 7:00 a.m. or at any time on Saturdays, Sundays and holidays, and must not exceed 80 dBA at the boundary at any other time.
Section 15-7(14) of the Town of Davie Code of Ordinances specifically addresses construction noise. It is unlawful to perform construction work, building, excavating, hoisting, grading, pile driving, pneumatic hammering, demolition, dredging, or building alteration or repair work, without a special variance, under two conditions. First, between 7:00 p.m. and 7:00 a.m. the following day, and at all times on Saturdays, Sundays and holidays, when the sound exceeds 50 dBA at a real property boundary. Second, at any other time when the sound level at a real property boundary exceeds 80 dBA for the daily period of operation. The holidays defined in Sec. 15-2 are New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas. Section 15-7(14)(c) clarifies that the construction limits do not apply to domestic power tools, which are governed separately under Sec. 15-7(10). A special variance may be requested under Sec. 15-11 by filing an application with the town's Department of Development Services and demonstrating that compliance would cause unreasonable hardship; neighbors within 500 feet must be notified and a sign posted on the property.
Construction noise violations are enforced through Code Compliance and the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. Continued violations after a notice and deadline can result in fines of up to $1,000 per day, and up to $5,000 per day for repeat violations. Work outside permitted hours requires a special variance under Sec. 15-11.
