Section 15-4 of the Town of Davie Code establishes maximum permissible A-weighted sound levels (dBA) by the receiving land use, measured at the boundary of the property receiving the noise. Per Table 1: Agricultural is 55 dBA from 6:00 a.m. to 7:00 p.m. and 50 dBA from 7:00 p.m. to 6:00 a.m.; Residential and Residential Office are 55 dBA from 7:00 a.m. to 7:00 p.m. and 50 dBA from 7:00 p.m. to 7:00 a.m.; Office/Business is 60 dBA at all times; Industrial and Utilities is 65 dBA at all times; Community Facilities is 60 dBA from 7:00 a.m. to 10:00 p.m.; and Recreation/Open Space and Commercial Recreation is 55 dBA from 10:00 p.m. to 7:00 a.m. A level is exceeded only when the limit is surpassed for more than fifty percent of a measurement period of at least ten minutes. Section 15-6 provides that for any source emitting a pure tone, the limits in Sec. 15-4 are reduced by 5 dBA. Section 15-9 clarifies that a violation may occur without a measurement being made. Many activities are also restricted as specific prohibited acts under Sec. 15-7 regardless of these levels.
Decibel-based violations are enforced by Davie Code Compliance (954-693-8237) through the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. After a notice and deadline, continued violations can draw fines of up to $1,000 per day, and up to $5,000 per day for repeat violations.
