Davie Sec. 15-7 bans operating a defective or overloaded vehicle that makes excessive noise (15-7(12)), modifying a muffler to increase noise above factory levels (15-7(17)), sounding a horn except as a danger warning (15-7(20)), and idling vehicles over 8,000 pounds more than 2 minutes near homes (15-7(16)).
The Town of Davie regulates motor vehicle noise through several parts of Section 15-7. Sec. 15-7(12), Vehicle defect or condition of load, makes it unlawful to operate a motor vehicle or motor-propelled boat so out of repair, defective, or under any condition of load, acceleration or deceleration as to create excessive and unnecessary loud or explosive noises. Sec. 15-7(17), Mufflers, prohibits modifying or changing the exhaust muffler, intake muffler or any other noise-abatement device in a manner that increases the noise above that emitted by the vehicle as originally manufactured. Sec. 15-7(20), Motor vehicle horns and signaling devices, makes it a violation to sound any horn or signaling device on a public right-of-way or public space except as a warning of danger. Sec. 15-7(16), Idling vehicles, makes it unlawful to operate the motor of a vehicle weighing more than 8,000 pounds for longer than 2 consecutive minutes while standing on private property within 150 feet of residential property, unless within an enclosed structure; emergency vehicles, public transportation, and delivery vehicles whose motor is integral to the delivery are exempt. Note that Sec. 15-8(1) exempts motor vehicles operating on a public right-of-way from the general Sec. 15-3 noise disturbance rule.
Vehicle noise issues are reported to Davie Code Compliance at 954-693-8237 (and police for on-road conduct) and enforced through the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. After a notice and compliance deadline, continued violations can result in fines of up to $1,000 per day, and up to $5,000 per day for repeat violations.
