The Town of Davie regulates amplified sound chiefly through Section 15-7(1) and 15-7(2). Under Sec. 15-7(1), operating, playing or permitting any radio, television, phonograph, drum, musical instrument, sound amplifier or similar device that produces, reproduces or amplifies sound is a violation: (a) between 7:00 p.m. and 7:00 a.m. the following day in a manner creating a noise disturbance across a real property boundary or within a noise sensitive zone, except for permitted public events; (b) when it creates a noise disturbance 50 feet from the device while operated in or on a motor vehicle on a public right-of-way or in a boat on public waters; or (c) when it disturbs anyone other than the operator on a common carrier. Sec. 15-7(2) addresses loudspeakers and public address systems: for noncommercial purposes between 8:00 p.m. and 7:00 a.m. when creating a disturbance across a residential boundary or within a noise sensitive zone; and for commercial purposes either whenever the sound creates a disturbance across a property boundary or a noise sensitive zone, or between 8:00 p.m. and 7:00 a.m. on a public right-of-way or public space. These are specific prohibited acts that apply notwithstanding the Sec. 15-4 decibel table.
Amplified sound complaints are handled by Davie Code Compliance at 954-693-8237 and enforced via the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. After a notice of violation and a deadline, continued violations can carry fines of up to $1,000 per day, and up to $5,000 per day for repeat violations.
