A violation of subsection C or D is a public nuisance under Chapter 13.90 and a misdemeanor under Chapter 13.70. On conviction the fine is not more than two hundred fifty dollars for a first offense, five hundred dollars for a second within twelve months, and seven hundred fifty dollars for a third; a fourth and later conviction in that window is one thousand dollars. The city can instead issue an administrative citation under Chapter 13.58, and can still issue a criminal citation for the same offense on a separate day.
