Aggressive manner means any of the following:(1)Conduct intended or likely to cause a reasonable person to fear bodily harm to oneself or to another, damage to or loss of property, or otherwise be intimidated into giving money or other thing of value;(2)Intentionally touching or causing physical contact with another person or an occupied vehicle without that person's consent;(3)Intentionally blocking or interfering with the safe or free passage of a pedestrian or vehicle by any means, including unreasonably causing a pedestrian or vehicle operator to take evasive action to avoid physical contact;(4)Using violent or threatening gestures toward a person; or(5)Persisting in closely following or approaching a person, after the person has informed a solicitor that such person does not want to be solicited or does not want to give money or any other thing of value to the solicitor.
Sec. 53-13. - Aggressive solicitations prohibited. No person shall solicit in an aggressive manner in any public place.

Section 53-12 defines "aggressive manner" as conduct intended or likely to cause a reasonable person to fear bodily harm or property loss, or to feel intimidated into giving money; intentionally touching another person or an occupied vehicle without consent; intentionally blocking or interfering with a pedestrian's or vehicle's safe passage, including causing evasive action; using violent or threatening gestures; or persisting in closely following or approaching someone after that person has said they do not want to be solicited. "Solicit" means asking, begging, requesting or panhandling by spoken, written or printed word, gesture or sign for an immediate donation or the sale of goods or services. Section 53-13 then flatly bans soliciting "in an aggressive manner in any public place."
Section 53-14 imposes a second, broader layer that applies to all solicitation, not just aggressive solicitation: no soliciting within 25 feet of a financial institution's entrance during business hours or an ATM while in service; no soliciting in a public parking lot or structure after dark; no soliciting on a public transit vehicle or within 50 feet of a stop; no soliciting a vehicle occupant at a gas pump or EV charger, or within 25 feet of a shopping-center driveway; no lingering, loitering or soliciting on a roadway median; and no soliciting inside a restaurant or a public restroom.
The city council's findings (§ 53-11) frame the article as a content-neutral time, place and manner regulation adopted under the police power in Article XI, Section 7 of the California Constitution, intended to address safety hazards, not to suppress the message of solicitation, and the article expressly preserves solicitation that is otherwise "permitted or authorized under any local, state or federal law."
Violations & Fines
Chapter 53's uniform penalty schedule in § 53-18 applies to aggressive-solicitation violations: a first offense is an infraction capped at a $100 fine, with an option to instead perform up to eight hours of community service if requested. A second violation of the same section within 364 days of the first citation carries a $200 fine, a third within the next 364 days carries $500, and a violation within 364 days of the third infraction citation is charged as a misdemeanor.
