Additionally, Tampa Ordinance 2013-89 bars solicitation in roadways with speed limits of 35 mph or higher, including most arterials around Westshore and Brandon. The U.S. Supreme Court Reed v. Town of Gilbert decision and 11th Circuit precedent limit content-based panhandling bans, so Tampa's rules focus on conduct (location and aggressive behavior). Tampa Police enforce alongside Hillsborough County Sheriff in unincorporated areas.
Violations are second-degree misdemeanors carrying up to 60 days jail and 500 dollar fines, and roadway-solicitation infractions can also result in civil traffic citations.
