Florida House Bill 105 (2022) amended FS 386.209, allowing municipalities for the first time to prohibit smoking in public parks and beaches, while preserving the right to smoke unfiltered cigars. Tampa adopted a comprehensive parks smoking ban in Ordinance 2022-100, codified in Code Chapter 16 (Parks), prohibiting cigarettes, cigars, and electronic vapor devices at every Tampa park, recreation center, sports facility, and city-operated waterfront. Designated smoking areas may be posted at limited venues. Hillsborough County enforces a parallel ban at unincorporated parks under separate ordinance.
Violations are non-criminal civil infractions under Tampa Code with fines up to 100 dollars per offense. Repeat offenses on the same day can stack penalties and trigger park trespass warnings.
