Summary

Racine County's disorderly conduct ordinance bars unreasonably loud, boisterous, or otherwise disorderly behavior in public or private places that provokes a disturbance: the provision county deputies use to break up loud house parties.

These county ordinances apply to unincorporated areas of Racine County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No person shall, in a public or private place, engage in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which such conduct tends to cause or provoke a disturbance.

(b) W.S.A. § 947.013(1)(a) and (1m), describing and defining offenses relating to harassment or intimidation of another person, exclusive of any penalty imposed thereby, is adopted by reference and made part of this chapter as though set forth in full. (Code 1975, § 12.10; Ord. No. 2008-27, pt. 2, 6-24-08) Cross reference(s)—Schedule of deposits for violation of the provisions in this section, § 5-3.

Full Breakdown

Sec. 11-6(a) prohibits violent, abusive, indecent, profane, boisterous, unreasonably loud, or otherwise disorderly conduct, in a public or private place, where the conduct tends to cause or provoke a disturbance. There's no separate 'loud party' ordinance; a house party that gets loud enough to disturb neighbors falls under this general disorderly-conduct standard, and any participant, not just the host, can be cited. Subsection (b) separately incorporates the state harassment statute, Wis. Stat. § 947.013(1)(a), (1m).

Violations & Fines

No section-specific fine. Chapter 11's default penalty applies: forfeiture of $25 to $1,000 plus prosecution costs, and up to 90 days in county jail if unpaid.
