Summary

Aurora, Illinois adopts the state's Smoke Free Illinois Act for combustible tobacco and separately bans electronic smoking devices anywhere smoking is already prohibited, plus outright on any school, preschool, or day care grounds citywide across all four counties.

It shall be a violation of this article to use an electronic smoking device in any place, or in a manner, prohibited under the Smoke Free Illinois Act, 410 ILCS 82/1, et seq., which is referred to, adopted, and made a part hereof as if fully set forth in this article. No person, employer, business entity, whether for-profit or nonprofit, shall permit the use of electronic smoking devices in an area under the legal or de facto control of that location and in which smoking is prohibited under the Smoke Free Illinois Act, 410 ILCS 82/1. Alternative nicotine product, vapor products and electronic smoking devices are prohibited in or on the grounds of any school including schools of higher education, preschool, or day care facility. (Ord. No. O18-032, 3-27-18)

Full Breakdown

City Code § 13-28 adopts the Smoke Free Illinois Act, 410 ILCS 82/1, by reference, then extends it: using an electronic smoking device anywhere combustible tobacco smoking is already banned under the state act is a violation of Article 13-III, and vapor products and alternative nicotine products are barred outright on the grounds of any school, preschool, or day care facility, with no exception. Separately, § 13-26 bans all smoking and tobacco use, indoors and out, on the entire City of Aurora police campus at 1200 East Indian Trail. The Aurora Police Department monitors and enforces compliance citywide under § 13-29.

Violations & Fines

Using an e-cigarette anywhere the Smoke Free Illinois Act bans smoking, or vaping on any school or day care grounds, violates § 13-28; the police campus ban at 1200 E. Indian Trail has zero exceptions.
