Ada County, ID Public Conduct: Outdoor Smoking Restrictions (2026)

Ada County Code section 2-2-8(B) makes it unlawful to light, use, inhale, or consume any tobacco product or electronic cigarette anywhere on Ada County parks and waterways property, which includes the Boise River Greenbelt, Barber Park, and every other park the Ada County Parks and Waterways Department manages, unless the smoker is standing inside a posted 'smoking permitted' area. Subsection C lets the Parks and Waterways Director designate those areas but requires the Director to post prominent signs reading 'Warning: Smoking Permitted' and to keep every designated area at least 25 feet from any outdoor playground, service line, building entrance, operable window or ventilation intake, outdoor arena, stadium, amphitheater, bleacher, grandstand, or public transportation platform under county jurisdiction.

If no such sign is posted, the absence itself is evidence the Director never approved smoking there. One carve-out exists for the smoker outposts and ash receptacles on the patio at the Barber Park Education and Event Center, and subsection D exempts smoking inside a parked or moving automobile within a park parking lot or roadway. The ordinance sits inside chapter 2, article 2 of the county code, the same chapter that regulates alcohol, camping, and wheeled devices on park property.
