Nassau County's Smoke-Free Air Act (Administrative Code Chapter 175) bans smoking and vaping in county parks, beaches, public buildings, transit areas, and many outdoor dining spaces, going beyond New York State's Clean Indoor Air Act.
Nassau County prohibits smoking in all enclosed public spaces, county-owned parks and beaches, within twenty feet of public-building entrances, on county transit, in playgrounds, and in many outdoor dining areas. Vaping and electronic cigarettes are treated the same as tobacco. Cannabis smoking, while state-legal for adults 21+, is barred wherever tobacco smoking is barred under NY Cannabis Law. Towns and villages may impose stricter rules. NCPD and county park rangers enforce the law, primarily through warnings and small fines. Enforcement is heaviest at popular county sites such as Eisenhower Park and Nickerson Beach.
Smoking in a posted no-smoking area can result in civil fines starting at fifty dollars, with higher penalties for repeat violations or for smoking near children's play areas.
