Salem, OR Public Conduct: Outdoor Smoking Restrictions (2026)

Salem's smoking chapter, SRC Chapter 45, bans smoking on city-owned park property citywide under Sec. 025(b), naming Geer Park specifically, while carving out the paved public plaza north of the Council Chambers at the Civic Center Complex, between Liberty Road SE and Commercial Street SE, south to Leslie Street SE. Smoking under the chapter covers lit pipes, cigars, cigarettes, cannabis, and any other weed or plant capable of being smoked, as well as e-cigarettes and vapor devices, under the Sec. 015 definition. Separately, Sec. 030 lets the Director designate public sidewalks and landscape strips adjacent to an eligible premises, meaning property meeting the public-services use classification, as smoke-free zones once the property owner registers a written No Smoking Policy under Sec.

035, covering at least 100 feet of city sidewalk, and pays for the required signage under Sec. 040. The Director has full discretion over whether to grant a request and where signs go. Enforcement splits along ownership lines: property owners police their own registered No Smoking Policy zones on their employees, while the City enforces the chapter itself on city property, including registered and signed sidewalks, per Sec. 045. Smoking bans inside other city buildings or offices are separately authorized under Sec. 025(a) and are posted with signs.
