Kitsap County, WA Public Conduct: Outdoor Smoking Restrictions (2026)

Chapter 10.32, "Marina Regulations," governs the Kingston Marina, a county-owned moorage facility in unincorporated Kitsap County. Section 10.32.030, titled "Smoking," states in full: "It is unlawful to smoke on floats in the Kingston Marina." The rule was adopted by Ordinance 36 (1967) § 3 and remains unchanged in the current code. It sits among a cluster of marina-specific prohibitions in the same chapter: § 10.32.010 bars discharging vessel sewage in the marina area, § 10.32.020 requires garbage and trash be placed in the containers provided at each pier, § 10.32.040 bans swimming and water skiing, § 10.32.050 bans fishing, § 10.32.060 closes the pier and dock to unauthorized persons after sundown, § 10.32.070 keeps children under sixteen off the docks and fingers unless accompanied by a parent or other responsible adult, and § 10.32.090 caps vessel speed at four miles per hour in the marina.

The smoking ban applies specifically to the floats, the floating dock sections where boats tie up, rather than to the marina's upland parking area. Because Kitsap County's authority as a county government reaches only the unincorporated area, this Kingston Marina smoking ban has no force inside the incorporated cities of Bremerton, Port Orchard, Poulsbo or Bainbridge Island, each of which enforces its own municipal code, and it does not reach the Suquamish or Port Gamble S'Klallam reservations. Kingston itself is an unincorporated community, so the county code, not a city ordinance, controls activity at its marina.
