Gaston County, NC Public Conduct: Outdoor Smoking Restrictions (2026)

Section 12-8 of the parks chapter is a flat outdoor ban: it shall be unlawful for any person to smoke, vape, or use any tobacco products in all Gaston County owned, leased, or operated parks. That single sentence, adopted originally in 2006 and most recently amended by Res. No. 2024-196 in May 2024, covers every county park property without a distance buffer or designated-area exception, unlike ordinances that only restrict smoking near playgrounds. It sits alongside other park conduct rules in the same chapter: section 12-7 separately bars discarding a lit match, cigarette or other flammable smoking material anywhere on park property, tying the smoking ban to the county's wildfire and litter concerns.

Enforcement of Chapter 12 runs through park personnel authorized by the board of commissioners and county law enforcement officers under section 12-15, who can issue citations and, under section 12-16(b), pursue a violation as a civil offense and/or misdemeanor under the applicable North Carolina General Statutes, including imprisonment not exceeding thirty days; section 12-15(a) also lets park authorities immediately suspend a violator from all parks for a period set by the severity of the violation. Beyond parks, the county's Board of Health adopted a broader tobacco rule effective July 1, 2020, prohibiting tobacco and e-cigarette use in local government buildings, grounds, vehicles, and indoor public places countywide, including inside municipalities, under Article III of Chapter 8; that rule carries its own $50 infraction fine and escalates to a $200 administrative penalty per day for a business that fails to enforce it on its premises after repeat notices, but it explicitly does not reach public streets, sidewalks, or outdoor public places that are not local government property.
