Thornton, CO Public Conduct: Outdoor Smoking Restrictions (2026)

Section 38-459, the city's main smoking-restrictions article, applies only to indoor areas; Section 38-460(5) expressly exempts the outdoor area of any business from that ban, so patios and sidewalk cafes are not restricted there. The genuine outdoor smoking rule sits instead in the parks and recreation chapter. Section 46-42(a) lists activities prohibited citywide in any park, parkway, open space, trail, recreational facility, recreation area, or body of water the city owns, unless expressly permitted by posted signage. Item (9) of that list bars smoking, using the same definition found at Section 38-457 (which reaches tobacco, e-cigarettes, and marijuana), within a 25-foot buffer of any playground or sand or beach volleyball court.

Separately, Section 46-45(f) bans tobacco use outright on any synthetic turf athletic field, alongside glass containers, metal cleats, and animals. The parks director may also post additional smoking restrictions under Section 46-42(b), which allows expansion of the prohibited-activities list by rule or regulation. Because the rule is tied to specific park features rather than every outdoor public space, a smoker standing well away from a playground or volleyball court in open turf is not automatically in violation, unless posted signage says otherwise.
