) reaches only enclosed county facilities and county vehicles, so it does not touch parks. The outdoor ban instead sits inside the Parks Ordinance's fire chapter. Section 8(1)(d), adopted June 14, 2022, bars a person on county park property from smoking or using a tobacco product, e-cigarette, or similar device or substance in any beach area, including sand areas, grass areas, decks, overlooks and other structures, or adjoining areas, as designated by signing. The ban covers vaping and e-cigarettes as well as combustible tobacco, and it extends past the sand itself to decks, overlooks and other beach structures, plus any adjoining zone the county posts with signage.

Section 8(1)(e) adds a companion litter rule: disposing of smoking waste or tobacco product waste in any of those same beach areas is a separate violation, so a smoker who steps just off the sand to smoke but still discards a butt on the beach remains in violation of that subsection. The rule sits under the fire section of the ordinance, alongside campfire and grill controls, because the county treats lit tobacco products as a fire and litter hazard on the beach rather than as a general indoor air-quality issue.

Muskegon County Parks and Recreation employees and Sheriff's Office deputies enforce the ban under the authority granted in Sections 1 and 21, and a violator is subject to removal from the park in addition to the ordinance's misdemeanor penalty.
