BPC section 25620 makes it an infraction to possess an open container of alcohol on a public street, sidewalk, parking lot, or other public place where consumption is prohibited. Local ordinances such as Riverside County Ordinance 539 reinforce the rule in county parks operated by Regional Park and Open-Space District, prohibiting possession or consumption except where specifically authorized by permit. Sheriff deputies and park rangers may issue citations. Special-event permits, including some Coachella Valley winery events and licensed festivals such as Stagecoach in Indio, may authorize designated alcohol areas under tightly regulated conditions.
Open container in public is an infraction with up to $250 fine. Repeat or aggravated violations may be charged as misdemeanor public intoxication under Penal Code section 647(f).
