Texas Penal Code 49.031 prohibits open alcohol containers in the passenger area of a motor vehicle on a public road, even when parked. Padre Island and Mustang Island beach driving areas allow open beverages by adults outside lifeguard, pier, and event no-alcohol zones. Public intoxication remains a class C misdemeanor under Texas law. During Spring Break and other events, the city posts temporary glass-free and alcohol-free zones with extra patrols. Beach drivers face DWI rules even on the sand.
Open containers in vehicles, glass on the beach, or drinking in posted alcohol-free zones can lead to citations, glass confiscation, and possible class B vehicle open container charges.
