Full Breakdown

Sec. 24.01.008 prohibits consuming or possessing alcoholic beverages (along with narcotics and gambling) in any county park. The only exceptions are the clubhouse at Delcastle Recreation Area, the conference facilities at Rockwood Museum, and other County facilities where the General Manager of the Department of Community Service authorizes sale, possession, and consumption. This is a parks-chapter rule covering County-run parkland; it is not a general county-wide open-container law, and it does not reach Wilmington or Newark, which run their own municipal codes and park systems outside this chapter.

Violations & Fines

Violations of Chapter 24 (Parks and Recreation), including Sec. 24.01.008, are punished under the general penalty in Sec. 1.01.009: a fine starting at $100 for a first conviction, rising to $125-$500 for a second within 12 months, and $150-$1,000 or up to 30 days in jail for a third. Public Works, Land Use, and Public Safety staff enforce the chapter, and permits or permit privileges can also be revoked.
