Adults 21+ may legally possess cannabis in Nassau County under NY Cannabis Law, but smoking or vaping cannabis in public is restricted to the same locations where tobacco smoking is permitted, and violations carry civil fines.
Under New York's Marijuana Regulation and Taxation Act, adults 21 and older may possess up to three ounces of cannabis flower or twenty-four grams of concentrate. However, public smoking or vaping is allowed only where tobacco smoking is allowed, meaning it is prohibited in Nassau County parks, beaches, near building entrances, and in the many areas covered by the Smoke-Free Air Act (Code Ch. 175). Driving under the influence remains a serious offense under NY VTL Β§1192. Some Nassau towns and villages opted out of retail dispensaries, but all retain the same public-use restrictions. NCPD enforces through summonses.
