Florida has not legalized recreational marijuana. Public consumption remains a state criminal offense even for medical-cannabis cardholders, who must use only in private. Orlando OPD enforces possession and public-use violations citywide.
Florida law does not permit recreational marijuana use. Amendment 3 (recreational legalization) failed at the November 2024 ballot, falling short of the required 60% supermajority. Medical marijuana is legal under Florida Statute Β§381.986 for qualified patients with state-issued cards through registered Medical Marijuana Treatment Centers. Even medical patients are barred from smoking cannabis in any public place. Orlando OPD enforces both possession violations and public-consumption offenses. Possession of under 20 grams remains a misdemeanor; larger amounts are felonies. Driving under the influence of cannabis is prosecuted under Florida DUI law.
