Summary

Using, carrying, transporting or selling marijuana in a Monroe County park is banned and prosecuted under state Penal Law.

These county ordinances apply to unincorporated areas of Monroe County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No person shall use, carry, transport or sell within a park any marijuana, narcotic drug, hallucinogen or controlled substance as defined in § 220.00, or drug paraphernalia as defined in § 220.50 of the New York State Penal Law. Violations of this section will be prosecuted in accordance with the New York State Penal Law. Violators will be subject to the penalties prescribed therein.

B. No person shall use an electronic cigarette, as that term is defined in New York State Public Health Law § 1399-aa, within 1) 100 feet of a County-operated lodge or shelter currently being rented and occupied within a park, or 2) 100 feet of a County-operated playground, beach, aquatic area, concession area, garden, carousel, or zoo within a park. This provision shall not apply to County employees or employees contracted to work for the County within outdoor areas of a park that are 1) not open to the public (e.g., park maintenance areas), and 2) designated by the County for such use.

Full Breakdown

The Monroe County Parks chapter prohibits marijuana, narcotics, hallucinogens or other controlled substances (and drug paraphernalia) within any county park, cross-referencing New York Penal Law §§ 220.00 and 220.50. The county funnels enforcement through state Penal Law penalties rather than a separate county fine schedule.

Violations & Fines

Prosecuted under NY Penal Law; violators face the penalties prescribed there, not a flat county fine.

Frequently Asked Questions

Is this a county fine or a criminal charge?
Violations are prosecuted under NY Penal Law, so penalties follow state criminal law rather than a separate county civil fine.
Does the section also cover vaping?
Yes, § 323-29(B) separately restricts e-cigarette use near county lodges, playgrounds, beaches and similar park areas.
