Chapter 341 of the Code of the Town of West New York was adopted by the Board of Commissioners on 3-15-1995 as Ord. No. 10/95 and amended in its entirety on 8-21-2002 as Ord. No. 17/02. It covers roller skates, roller blades, in-line skates, skateboards and scooters. A skateboard is a piece of wood or other material mounted on skate wheels, and a scooter is a low board fitted with a wheel at each end and a steering handle. Section 341-7 sets the places where use is prohibited. A person under the age of 14 cannot operate these devices on state roadways, county roadways or any roadway section with a posted speed limit in excess of 35 miles per hour. Between 9:00 a.m. and 9:00 p.m., the same age group is barred from streets and sidewalks in these business districts: Bergenline Avenue from 49th to 67th Street, Park Avenue from 49th to 67th Street, 60th Street from Kennedy Boulevard to Boulevard East, and Boulevard East and Kennedy Boulevard from 49th to 67th Street. Section 341-7(E) is not limited by age: no person can operate or use any of these devices in any park, ball field or playground in the Town.

Motorized roller skates, scooters and skateboards are prohibited, and the motor need not be engaged for a violation (§ 341-8).

Any person violating Chapter 341 is fined a minimum of $50 and a maximum of $1,000 per offense, set by the Judge of the Municipal Court (§ 341-9). A police officer who witnesses a motorized scooter violation confiscates the device until the violator pleads guilty and pays the fine or is found not guilty by the Municipal Court (§ 341-8). For a rider under 14 without protective gear, the enforcing official issues a warning and the parent or guardian can be fined up to $1,000 per offense, waived on proof that an approved helmet or protective equipment was bought after the violation.
