Summary

Suffolk County contracts for food and beverages on county-owned property, parks concessions, cafeterias, and vending machines, must post caloric information for every item and meet strict nutrition limits under County Code Chapter 36.

These county ordinances apply to unincorporated areas of Suffolk County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

§ 36-5. Exemptions. § 36-6. Enforcement.

A. The terms of this article shall be enforced by the County departments which administer contracts for the provision of food or beverages on County property.

B. The violation of the terms of this article, which are contained in contracts for the provision of food and beverages, shall constitute grounds for termination of a contract.

§ 36-7. Applicability. This article shall apply to all concession, cafeteria and vending machine contracts entered into on or after the effective date of this article.

Full Breakdown

Suffolk County Code § 36-4B(3)(b) requires vending machines on County-owned property to post caloric information for each item, sized to the package offered for sale. The same 2014 law (L.L. No. 24-2014) caps beverage and snack calories, sodium, and fat in county park concessions, cafeterias, and vending machines, and requires promotional space to advertise only items meeting the healthier standards. Restaurants served by wait staff at county golf courses, the correctional facilities, Long Island Ducks Stadium, the Vanderbilt Museum, and Suffolk County Community College campuses are exempt. The rules bind county contracts, not private businesses off county property.

Violations & Fines

Vendors under county food-service contracts that skip the required caloric information or nutrition standards breach their contract; the county department administering that contract can terminate it for noncompliance.
