Stearns County Ordinance 272 bars rental property owners and tenants from letting scrap materials pile up as rodent shelter and requires stored materials to sit at least 10 feet from any dwelling and one foot off the ground, plus rodent-proofing of any opening a half inch or larger.

These county ordinances apply to unincorporated areas of Stearns County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

4.6 Rodent Harborages and Food. No owner or occupant of a rental dwelling unit shall accumulate or allow to accumulate boxes, lumber, wood, scrap metal or any other similar materials in such a manner that may provide a rodent harborage in or about any rental dwelling unit. Stored materials shall be stacked neatly in piles at least ten (10) feet away from any dwelling unit and one (1) foot above the ground. No owner or occupant of a rental dwelling unit shall store, place or allow to accumulate any materials that may serve as food for rodents in a site accessible to rodents.

Full Breakdown

6 of Ordinance 272, 'Rodent Harborages and Food,' prohibits any owner or occupant of a rental dwelling unit from accumulating boxes, lumber, wood, scrap metal or similar materials in a way that could shelter rodents, and requires stored materials to be stacked neatly at least ten feet from any dwelling unit and one foot above the ground. It separately bars leaving out anything that could serve as rodent food where rodents can reach it. 5 assigns extermination duty: a tenant handles pest control when only their own unit is infested, but the owner must exterminate whenever infestation stems from the owner's failure to keep the building rodent-proof, or whenever two or more units or shared/public areas are infested.

4, 'Rodent Proof,' goes further on the building itself: every dwelling, accessory structure and premises must be kept rodent-free and rodent-proof, and any opening in an exterior wall, foundation, basement, floor or roof measuring a half inch in diameter or larger must be rodent-proofed in an approved manner. 1 requiring correction within a set time.

Violations & Fines

A confirmed Section 4.6 or 6.4 violation draws a written Compliance Order under Section 8.1 with a correction deadline, appealable to the Board of Adjustment within 30 days. Ignoring the order is a misdemeanor under Section 10.1, punishable by a fine up to $1,000, up to 90 days in jail, or both, with each day of continued violation a separate offense.

Frequently Asked Questions

How far from a Stearns County rental must stored materials be kept to avoid a rodent harborage violation?
Section 4.6 requires that boxes, lumber, scrap metal and similar stored materials be stacked neatly at least ten feet away from any dwelling unit and one foot above the ground, so rodents cannot nest underneath or against the building.
Who is responsible for exterminating rodents in a Stearns County rental with multiple units?
Section 4.5 puts extermination on the owner whenever two or more units are infested, when shared or public areas are infested, or when the infestation results from the owner's failure to keep the building rodent-proof; a tenant is responsible only when their own unit alone is infested through no fault of the owner.
What size gap in a wall or foundation counts as a rodent-proofing violation?
Section 6.4 requires rodent-proofing of any opening in an exterior wall, foundation, basement, ground or first floor, or roof that is a half inch in diameter or larger, applying to the dwelling, accessory structures and the surrounding premises alike.
