Summary

Lake County Code Section 13-10 requires property owners to clear garbage and refuse within seven days to stop rodent and vector harborage, mandates watertight containers no larger than 96 gallons with tight covers, and bans outdoor storage of garbage in plastic bags, enforced countywide in the unincorporated area.

These county ordinances apply to unincorporated areas of Lake County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

10.2 Required Removal of Garbage and/or Refuse. a. The owner or tenant of any premises, business establishment or industry shall be responsible for the satisfactory removal of all garbage and/or refuse accumulated on such premises. To prevent propagation, harborage or attraction of flies, rodents or other vectors and the creation of a nuisance, garbage and/or refuse, excepting nonflammable inert material, shall not be allowed to remain on the premises for more than seven (7) days. b. All garbage and/or refuse shall be drained, wrapped, and stored in durable, rust-resistant, nonabsorbent, watertight containers not to exceed ninety-six (96) gallons capacity and which have tight-fitting covers. Plastic garbage bags are not to be used for outside storage of garbage at any time.

Full Breakdown

1(e)(7). 2(a) puts a hard clock on it: to prevent the propagation, harborage, or attraction of flies, rodents, or other vectors, garbage and refuse other than nonflammable inert material cannot remain on the premises for more than seven days. Subsection (b) sets container standards: garbage must be drained, wrapped, and stored in durable, rust-resistant, nonabsorbent, watertight containers not exceeding ninety-six gallons with tight-fitting covers, and plastic garbage bags may never be used for outside storage. Garbage cannot be stored in a trailer or vehicle except while actively being transported for lawful disposal.

Even nonflammable inert material that is not properly stored cannot become a rodent or vector harborage and must be removed within thirty days if unmaintained. Multifamily dwelling owners must contract with a franchise hauler or otherwise take responsibility for disposal, and receptacles serving those properties must be emptied at least once a week and before contents reach the rim. Section 13-3(e)(8) separately lists items that provide harborage for rats or other vermin among the conditions the County treats as a nuisance, reinforcing the same vector-control purpose across the chapter.

The Enforcement Official administers these rules and may require a maintenance plan, including proof of regular garbage service, as a condition of an abatement order.

Violations & Fines

A first violation draws an administrative penalty of up to $100 per day it continues; a second violation of the same provision within a year rises to $200 per day; any further repeat within that year reaches $500 per day, under Section 13-13.2(b). After a second violation, or after any egregious violation left unremediated for ten or more days, the Enforcement Official can require the owner to subscribe to garbage collection service or enter a compliance agreement and reimburse the County's monitoring costs.

Frequently Asked Questions

How long can garbage sit on a property in Lake County before it's a violation?
No more than seven days. Section 13-10.2(a) requires removal within that window specifically to prevent the propagation, harborage, or attraction of flies, rodents, or other vectors, with nonflammable inert material the only exception.
What kind of garbage containers does Lake County require?
Durable, rust-resistant, nonabsorbent, watertight containers with tight-fitting covers, capped at 96 gallons, per Section 13-10.2(b). Plastic garbage bags cannot be used for outside storage of garbage at any time.
What happens after a second rodent-attracting garbage violation in Lake County?
The daily fine jumps from $100 to $200 per day under Section 13-13.2(b), and the Enforcement Official can require the owner to subscribe to a garbage collection service or sign a compliance agreement covering the County's monitoring costs.
How often must multifamily property dumpsters be emptied in Lake County?
At least once a week, and before the contents reach the top of the receptacle, per Section 13-10.2(f). Owners must either contract with a franchise hauler or take on disposal responsibility themselves.
