Saline County, AR Rental Property Rules: Repairs & Habitability (2026)

Adopted as Ordinance No. 2008-009 on February 19, 2008, the Property Code for Hot Springs Village applies to all residential and commercial structures and premises within the Saline County portion of the village, setting minimum standards for exterior maintenance regardless of occupancy status; the code's own definitions cover a 'residential structure' whether occupied, unoccupied, owned and occupied, or rented and leased. Responsibility is joint: the owner, any tenant and any occupant in physical control of the property must all ensure it stays in compliance, so a landlord cannot point to a tenant's neglect to avoid enforcement.

The Compliance Officer, defined as the Director of Planning and Inspections employed by the Hot Springs Village Property Owners' Association or a designated staff member, issues written notices identifying the violation and a correction deadline set at the officer's reasonable discretion. State- and locally-certified law enforcement officers issue criminal citations when an owner, tenant or occupant fails to comply with a notice, after complying with constitutional entry protections before inspecting private property. A first conviction for violating any provision of the Code carries a fine of $20 to $500; a second or later conviction carries $40 to $500.
