Just cause eviction rules in St. Joseph County, IN β sometimes called tenant protection or "for cause" eviction ordinances β list the specific legal reasons a landlord can end a tenancy.
Indiana has no just-cause eviction. In St. Joseph County a landlord may end a tenancy without giving a reason. For unpaid rent, IC 32-31-1-6 requires at least a 10-day notice to pay before termination.
No Indiana law makes a landlord prove cause to end a tenancy. When a fixed lease expires the landlord need not renew or explain. For nonpayment, Section 32-31-1-6 lets a landlord terminate with not less than ten days' notice unless the lease sets different terms or the tenant pays in full first. A month-to-month tenancy ends with one month's notice under IC 32-31-1-1. Neither South Bend, Mishawaka, nor the county can add a just-cause standard or relocation payment; IC 32-31-1-20 preempts local landlord-tenant rules. The tenant's protection is the court process, proper notice, a hearing, and a judgment before the sheriff removes anyone.
A landlord who skips the 10-day notice or attempts a self-help lockout can have the eviction dismissed and owes damages. Indiana requires a court order, not changed locks, to remove a tenant.
