Without rent control under Texas Property Code 92.0091, landlords may freely raise rent at lease renewal to absorb tax, insurance, or maintenance cost increases. Bexar County does not limit how much a landlord can pass through during the term of a lease, but the lease must spell out any variable charges. Texas Property Code 92.019 caps late fees, and 92.0561 governs reasonable repair-cost reimbursement. Pass-through charges added mid-lease without lease authorization are unenforceable. Many Bexar County leases include CAM (common-area maintenance) escalators in multifamily and triple-net commercial-style leases, which Texas courts uphold when clearly disclosed.
Unauthorized mid-lease pass-throughs are unenforceable. Excessive late fees beyond Property Code 92.019 caps (12% of monthly rent for single-family, 10% for multifamily of four-plus units) trigger refund obligations and statutory damages.
