AB 12 (2023) reduced the California security-deposit cap from two months (unfurnished) or three months (furnished) to a single uniform one-month cap for most rentals starting July 1, 2024. Small landlords (two or fewer properties, four or fewer units) may still charge up to two months' rent. Landlords must return the deposit within 21 days after move-out with an itemized statement of any deductions and supporting receipts for repairs over $125. Wrongful retention exposes the landlord to up to twice the deposit amount in statutory damages plus actual damages.
Charging deposits above the cap, failing to return within 21 days, or withholding without itemized receipts exposes landlords to twice-deposit statutory damages plus actual losses in small claims court.
