California Civil Code §1950.5 governs security deposits in Moorpark, capping most residential deposits at one month's rent as of July 2024 and requiring itemized return within 21 days after move-out.
AB 12, effective July 1, 2024, lowered the deposit cap to one month's rent for unfurnished and furnished residential rentals, with a small-landlord exception allowing two months for owners of two or fewer properties with no more than four units. Landlords must return the deposit, with an itemized statement of any deductions and copies of receipts for repairs over $125, within 21 calendar days of the tenant vacating. Pre-move-out inspection rights also apply on tenant request. Moorpark does not add local deposit rules.
Withholding deposits in bad faith exposes landlords to up to twice the amount in statutory damages plus the actual deposit owed, under Civil Code §1950.5(l).
