Summary

Mendocino County Code Chapter 10A.13 shields established commercial agricultural operations from nuisance suits once they've run more than three years without negligence, under Sec. 10A.13.020. Anyone selling or leasing property zoned Agricultural Land, or within 300 feet of it, must disclose the dust, odor, noise and chemical use that come with farming under Sec. 10A.13.040.

These county ordinances apply to unincorporated areas of Mendocino County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Sec. 10A.13.020 - Policy. ...No existing or future agricultural operation or any of its appurtenances, conducted or maintained for commercial purposes, and in a manner consistent with proper and accepted customs and standards, shall become or be a nuisance, private or public, for adjacent land uses in or about the locality thereof after the same has been in operation for more than three (3) years, when such action was not a nuisance at the time it began; provided that the provisions of this subsection shall not apply whenever a nuisance results from the negligent or improper operation of any such agricultural operation or its appurtenances. ...

Sec. 10A.13.040 - Disclosure. (A)...The property described herein is zoned as "Agricultural Land", or is located within 300 feet of such land and residents of the property may be subject to inconvenience or discomfort arising from use of agricultural chemicals, and from the pursuit of agricultural operations...

Full Breakdown

13 (Agricultural Nuisances and Consumer Disclosures), by Ord. No. 3414 in 1983 and amended it by Ord. No. 3463 the same year. Sec. 020 declares the county's policy to conserve and encourage agricultural production and bars any commercial agricultural operation, once it has run for more than three years without the action being a nuisance when it began, from being declared a private or public nuisance for neighboring land uses, unless the nuisance stems from negligent or improper operation. Sec. 052, and note that residential development next to those districts often pressures farm operations to curtail themselves.

To warn incoming residents, Sec. 040 requires anyone selling or leasing real property that is zoned Agricultural Land, or sits within 300 feet of Agricultural Land, to disclose in the sale or lease document that dust, smoke, noise, odor and agricultural chemicals are normal and expected. Sec. 040(C) goes further for construction: before Planning and Building Services can issue a building permit for a residence on or within 300 feet of Agricultural Land, the property owner must sign a statement acknowledging those same conditions, unless the disclosure already appears in a signed sale or lease document.

Sec. 050 lets the county post signs at the entrance to established farming areas warning buyers that producers' interests are legally protected, and Sec. 060 gives this chapter precedence over any conflicting county ordinance.

Violations & Fines

Chapter 10A.13 is a shield and disclosure statute, not a penalty statute: it forfeits an agricultural operation's nuisance immunity only where the nuisance results from negligent or improper operation, per Sec. 10A.13.020. On the housing side, Planning and Building Services will not issue a building permit for a residence on or within 300 feet of Agricultural Land under Sec. 10A.13.040(C) until the owner signs the required disclosure acknowledgment.

Frequently Asked Questions

Can my neighbor sue an existing farm for noise or odor in Mendocino County?
Not if the operation is commercial agriculture that's run more than three years without the practice being a nuisance when it started. Sec. 10A.13.020 bars that kind of nuisance claim, though the protection doesn't cover a nuisance caused by negligent or improper operation of the farm.
Do I have to tell buyers my property is near farmland?
Yes, if the property is zoned Agricultural Land or sits within 300 feet of it. Sec. 10A.13.040(A) requires the seller or their agent to include a written disclosure about dust, chemicals, noise and odor from nearby farming in the sale or lease documents.
Do I need to sign anything before building a house near farmland?
Yes. Sec. 10A.13.040(C) requires anyone building a residence on or within 300 feet of Agricultural Land to sign a statement acknowledging the inconveniences of nearby farm operations before Planning and Building Services will issue the building permit, unless that disclosure is already in a signed sale document.
Does this ordinance apply to every zoning district in the county?
It applies specifically to land zoned Agricultural Land and to any parcel within 300 feet of it, which under the county's zoning includes the A-G Agricultural District as well as Rangeland, Forestland and Timberland Preserve districts described in Sec. 10A.13.010's definitions.
