Delano Development Code §20.10.270.4 requires the Community Development Director to include a Right-to-Farm notice on any proposed land division that lies partly or wholly within or within 300 feet of agriculturally-zoned land.
The notice informs buyers that agricultural activities — including cultivation, livestock, poultry, beekeeping, harvesting, and equipment operation — conducted for commercial purposes and consistent with local custom for more than 3 years shall not be deemed a nuisance. The City Engineer must also include this notice on any final land division proposed for recordation in those areas.
Failure to record the notice doesn't invalidate the §20.10.270.3 nuisance protection but may expose the City to claims from buyers.
