Under Florida Statute §509.032(7)(b), local governments may not prohibit vacation rentals or regulate their duration or frequency unless an ordinance predated June 1, 2011. Tallahassee did not adopt a qualifying pre-2011 ordinance, so no citywide STR insurance mandate exists in the Code of Ordinances. Instead, hosts must obtain a state Vacation Rental Dwelling License from the Department of Business and Professional Regulation (DBPR), which requires submitting proof of liability insurance. Leon County's tourist-development tax registration also applies. The city enforces only general nuisance, noise, and housing-code standards against short-term rental properties.
