Atlanta Code Ch. 30, Art. VIII does not set a maximum number of rented nights per year like some cities do. Instead, it caps how many properties a single host can license: one primary residence and one non-primary property. Any additional STR properties held by the same natural or legal person are prohibited. The ordinance also prohibits licensing by corporate entities that are not natural persons in some cases, to curb commercial operators buying up neighborhood homes. Investors who owned multiple units before the 2021 ordinance had a wind-down period; new investors cannot license a third property.
Operating a third STR, or operating without a license, can result in fines and license revocation for remaining properties.
