Unlike cities such as Dallas or Austin that have considered or adopted night caps or primary-residence requirements, Mansfield currently has no ordinance limiting the number of rental nights per calendar year for a short-term rental. The operative threshold is the 30-day rule under Texas Tax Code Chapter 156 and 351: stays of fewer than 30 consecutive days are subject to 6 percent state HOT and 7 percent Mansfield HOT, while stays of 30 days or longer are not. Mansfield HOAs in master-planned communities such as South Pointe, Walnut Creek, and Mansfield National may impose minimum lease terms (often 6 months or 1 year) under CCRs recorded pursuant to TX Property Code Chapter 202. If the CCR restriction on short-term leasing was recorded before a new owner took title, it is enforceable under TX case law including Garrett v. Bendig and similar holdings. Some insurance providers and mortgage lenders also impose de facto night caps. If Mansfield City Council adopts a formal STR ordinance in the future, night caps and primary-residence rules could change the landscape.
