Because short-term rentals are banned in Paramus under Chapter 322 Article II of the Borough Code, there are no STR-specific noise rules. Any guests who are nonetheless present at an unlawful STR must comply with the borough's general noise ordinance, Chapter 309 of the Paramus Code, which prohibits loud or disturbing noise between 11:00 p.m. and 7:00 a.m. and uses a 50-foot plainly-audible standard for amplified sound. Recurring noise complaints can also be cited as evidence of an unlawful STR use under Chapter 322.
Paramus has no separate STR noise code because short-term rentals of 30 days or less are not a permitted use under Chapter 322 Article II of the Borough Code (Ord. No. 2016-25, adopted 10-18-2016). The general municipal noise ordinance is found at Chapter 309 of the Paramus Code. Chapter 309 makes it unlawful to make, continue, or cause any loud, unnecessary, or unusual noise that annoys, disturbs, injures, or endangers the comfort, repose, health, peace, or safety of others within the borough, with quiet hours running from 11:00 p.m. to 7:00 a.m. Sound from a radio, television, musical instrument, phonograph, or other sound-reproducing device is prohibited when it is louder than is necessary for convenient hearing of the user; sound that is plainly audible at a distance of 50 feet from the building, structure, or vehicle is prima facie evidence of a violation. Contractor or construction-style work in residential zones is restricted to 7:00 a.m. to 7:00 p.m. Homeowners performing their own home-improvement or yard work on their own property may work between 7:00 a.m. and the later of 7:00 p.m. or dusk. Because Paramus declares unlawful STR activity to be a 'public nuisance' and 'nuisance per se' under Chapter 322 Article II, recurring noise or party complaints traced to a 30-day-or-less rental can be used to establish the underlying STR violation in addition to the noise charge. Enforcement is shared by the Paramus Police Department for noise complaints and the Building Code Official, Fire Official, and Health Department for STR violations.
Noise violations under Chapter 309 are enforced by the Paramus Police Department and prosecuted in municipal court, with fines set by the Borough's general penalty schedule. A separate Chapter 322 Article II violation for operating or facilitating an unlawful short-term rental carries a maximum civil fine of $1,250 per adjudicated violation. The owner, advertiser, host, and platform user may all be liable, and each day a violation continues may be treated as a separate offense for nuisance abatement purposes.
