A first violation of Chapter 3 noise/disturbance provisions is typically prosecuted in Mahwah Municipal Court with fines up to $1,250 and/or up to 90 days in jail under N.J.S.A. 40:49-5, the maximum for general municipal ordinance offenses. Disorderly persons offenses under N.J.S.A. 2C:33-2 carry up to a $1,000 fine and 6 months in jail.
