The proposed Arapahoe County STR licensing program sets occupancy at 2 guests per bedroom plus 2 additional, not to exceed 12 guests regardless of bedroom count. A bedroom is defined per building code: minimum 70 sq ft, at least one operable window meeting egress requirements, and a closet. Sleeping in non-bedroom spaces (garages, attics, basements without egress), RVs, tents, or outbuildings on the STR lot is prohibited. Occupancy figures must be posted inside the rental and accurately stated in all listings. Local responsible agents are required to respond within 15 minutes and be on-site within 60 minutes for occupancy complaints. Events and gatherings may be capped at the occupancy limit (no party-rental exceptions) unless the host obtains a separate special event permit.
First violation: written warning plus mandatory occupancy-cap re-posting. Second: $500 fine. Third within 12 months: license suspension for 30 days. Chronic overcrowding may result in permanent license revocation.
