Chapter 510, adopted by the Municipal Council on May 22, 2023, reinforces this by making it unlawful to receive consideration for soliciting, advertising, offering, or permitting use of any dwelling unit for less than 30 days, with violations declared a public nuisance per se. Because true short-term rentals are not lawful, no transient occupancy cap exists. For lawful rentals of 30 days or more, occupancy is governed by the NJ Uniform Construction Code (NJAC 5:23-3) and the International Property Maintenance Code (IPMC) adopted by the state, which set minimum sleeping-room area (typically 70 sq ft for one occupant, 50 sq ft per additional occupant) and limit the total number of persons based on habitable floor area. Chapter 467 further requires that each Certificate of Habitability issued by the Township specify the maximum number of persons by which the dwelling unit may be occupied.
